Warning, Waiver, Release of Liability, Acknowledgment of Assumption of Risk and Agreement to Participate

READ CAREFULLY BEFORE SIGNING

THIS AGREEMENT MUST BE SIGNED BY ALL MEMBERS, GUESTS, PARTICIPANTS, OR OTHERS WHO WISH TO PARTICIPATE IN ANY TRAINING OR OTHER ACTIVITIES AT OR AFFILIATED WITH UNITY TRAINING CENTER.

In consideration of being permitted to participate in any way in the Martial Arts Program at Unity Training Center (Releasee) indicated below and/or being permitted to enter for any purpose, the participant, member, or the parent(s) and/or legal guardian(s), individually and as next friend of the minor participant (Releasor) named below hereby agrees:

The participant shall, or the parent(s) and/or legal guardian(s), individually, and as next friend of the minor participant, shall instruct the minor participant that, prior to participating in the below martial arts activity or event, he or she should inspect the facilities and equipment to be used, and if he or she believes anything is unsafe, the participant should immediately advise the officials of such condition and refuse to participate.

I understand that there are risks and dangers in participating in martial arts and that, in order to participate in any such activities at Unity Training Center or events/activities affiliated with Unity Training Center, including but not limited to Brazilian Jiu Jitsu, Muay Thai, Boxing, Mixed Martial Arts, Wrestling, Kids Classes and the Conditioning Classes, I must hold harmless Unity Training Center, Unity Training Center, LLC and any other entity associated with Unity Training Center, LLC, for any responsibility or liability for any damage that I may suffer while participating in such classes / training / seminars provided by Unity Training Center, waiting at or on Unity Training Center premises to participate in such classes / training, walking through the premises at Unity Training Center prior to or after such classes.

Knowing this and in consideration for being permitted to participate in martial arts classes / training with Unity Training Center, I hereby voluntarily forever release, discharge and hold completely harmless Unity Training Center, LLC, and all other entities associated with Unity Training Center, LLC, and their members, agents, employees, heirs, assigns and independent contractors from any and all responsibility for, or liability resulting from or arising from, my participating in martial arts classes/training at Unity Training Center, and being on the premises at Unity Training Center.

I certify that I am in good physical and mental well-being during intense training practice and/or competition. Further, I hereby grant permission in case of injury to have a doctor, nurse, athletic trainer, or other emergency medical personnel provide medical assistance or treatment of such injury.

I realize that these activities, as well as all other martial arts activities, can be dangerous, but I am voluntarily choosing to participate in some or all of these activities and agree to assume the risk associated with my participation therein.

Further, I understand and acknowledge that injuries received may be compounded or increased by negligent rescue operations or procedures of the released. I understand that I am assuming full responsibility for any and all risks of death, personal injury, emotional pain and suffering, property damage and economic loss that might be suffered by me as a result of my participation in martial arts classes at Unity Training Center, LLC.

I agree that this release shall bind me, my spouse, my heirs, my personal representatives, my assigns, my children and my and their agents.

I hereby further agree to release, indemnify and hold completely harmless Unity Training Center, and all other entities associated with Unity Training Center, LLC, and their members, agents, employees, heirs, assigns and independent contractors harmless from any and all liability and costs, including attorney fees, associated with or arising from my participating in martial arts classes, conditioning classes, private training, and seminars at Unity Training Center, waiting at or on Unity Training Center premises to participate in such classes / training, and walking through the premises at Unity Training Center prior to or after such classes/training from any causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

I have expressly assumed all the risks associated with participation in such activities, including but not limited to negligence on the part of the martial arts / fitness instructors in the performance of their duties, negligence by other members of Unity Training Center, LLC, negligence in the operation of machinery or equipment, and/or premises liability.

If I am signing this release on behalf of a minor child, I understand that I am giving up the same rights for the said minor as if I signed this release on my own behalf.

ACKNOWLEDGMENT

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
